Spécialisée dans les fournitures de bureau, la société Office DEPOT France avait été placée en redressement judiciaire le vendredi 5 février 2021 à l’issue d’une audience devant le Tribunal de commerce de Lille Métropole.
Propriété du fonds de retournement allemand Aurelius, créé en 2005 par Dirk Marius et Gert Punkert, le groupe Office DEPOT avait retenu l'attention de 13 candidats à la reprise. Lors de l'audience d'arrêté du plan de cession du 3 juin 2021, les deux offres les plus sérieuses subsistantes ont été examiné par le Tribunal : celle présentée par Adexgroup, Adveo et le fonds d'investissement Sandton Capital et celle présentée par la coopérative Alkor Groupe. C'est cette dernière qui avait été finalement retenue par le Tribunal de commerce de Lille Métropole.
Alkor Groupe commercialise depuis 60 ans sur toute la France des produits de papeterie et des fournitures de bureaux à travers 3 marques : Majuscule, Burolike et Ioburo. Aux termes de son offre de reprise, le groupe a repris 460 salariés de la branche retail d’Office DEPOT France. Dans le cadre d’une bourse à l’emploi opérée par AKSIS, Alkor Groupe offre par ailleurs, au cours des deux prochaines années, des emplois à 370 collaborateurs dans les fonctions commerciales, IT et support.
Cependant, le CSE central d’Office DEPOT France avait interjeté le 8 juillet 2021un appel en nullité pour excès de pouvoir contre cette reprise devant la Cour d’appel de Douai pour divers motifs.
Par un arrêt en date du 9 juillet 2021, la Cour d’appel de Douai a finalement tranché et rejeté le recours en estimant que l’excès de pouvoir n’était pas démontré et confirmant donc la reprise par Alkor Groupe. Le Parquet Général a rappelé à l’appui de la confirmation que « c’est le caractère sérieux de l’offre du groupe Alkor dans ses différentes composantes qui a été retenu par le tribunal dans le cadre de son pouvoir souverain d’appréciation ».
