Healthcare professional negligence and loss of opportunity : statistical data are not enough

In its ruling of 8 February 2023, the Court of Cassation reiterated that the fault of a healthcare professional does not necessarily imply a loss of opportunity and that it is impossible to compensate a hypothetical loss.
